Karen L. Bashor (Partner-Las Vegas) and Colt B. Dodrill (Of Counsel-Phoenix) authored the cover article "The Delicate Balance - Countering Plaintiffs' Bar Attempts to Fracture The Tripartite Relationship" for the April 2024 posting of CLM Magazine. In light of increasing Plaintiff's Bar coordination in insurance claims litigation yielding more excess verdicts, Karen and Colt cleverly suggest that defense counsel consider Isaac Newton's "Mathematical Principals  of Natural Philosophy" and his corollary three laws of motion to both "prevent a strategic imbalance in favor of claimants," and "help preserve the delicate relationship between the insured, insurer and defense counsel to best resolve claims and limit excess exposure for all." The authors explore tools frequently used by claimants' counsel to "disrupt the tripartite relationship" and discuss "equal and opposite” tools the defense can employ "to maintain the balance of power with the claimant's side while protecting the interest of the insurer and insured, as well as its own."
