Ricki Roer (Partner-New York, NY) was quoted in a March 25, 2022, City & State article titled “Lawyers Say NYC’s Lifted Vaccine Mandate for Athletes, Performers Poses Legal Liability.” In the wake of Mayor Eric Adams’s reversal of mandatory vaccination for athletes and performers, it is expected that the city will face new litigation, especially after laying off 1,400 employees for refusing to meet vaccination requirements. However, challenges may not be successful. Ricki told City & State “an arbitrary and capricious standard is very difficult to meet” and the mayor could use “any arguably reasonable basis to defeat the challenge.”
