Jacqueline J. Harding (Partner-Los Angeles, CA) and Devon S. Mills (Associate-Los Angeles, CA) filed a demurrer that was sustained by the Superior Court, Ventura County, CA, resulting in a full dismissal for the firm’s government housing complex client. The plaintiff, a tenant of one of our client’s properties, alleged the housing company was negligent in its maintenance of the property. Jackie and Devon were granted a demurrer on the grounds that the plaintiff failed to show she presented a timely claim for damages prior to filing her lawsuit, as is required by the California Government Code. The plaintiff attempted to petition the court for permission to present a late claim to the housing company, citing COVID-19 had tolled the statute of limitations as the reason for the delay; however, Jackie and Devon were successful in defeating this argument as well, resulting in a dismissal of the case.
