Gary Pancer (Partner-Los Angeles, CA) and Monica Marks (Associate-Seattle, WA) concluded a five-day trial in Los Angeles Superior Court, securing Civil Harassment Restraining Orders on behalf of two physical therapists against their former patient. The male therapists were accused of stalking and harassment by a former female patient (a Hollywood producer/editor) who filed restraining orders of her own against the therapists alleging they were stalking her and made numerous threats on her life for filing complaints with the physical therapy board. The case was pending for close to a year with a prior interim restraining order issued by the court (without an evidentiary hearing) against one of our clients. The court found that Gary and Monica met their burden of clear and convincing evidence in establishing that the former patient was engaged in a pattern of stalking behavior directed at the clients that resulted in substantial emotional distress. In an extraordinary ruling, the judge issued a restraining order for a period of three years preventing the patient from interacting with or coming within 100 yards of our clients, their place of employment, their families, schools of their children, vehicles or other protected persons. The order requires the former patient to be registered on law enforcement databases, prevents her from possessing any firearms, and subjects her to arrest and imprisonment for any violation of the restraining orders. The former patient’s temporary restraining order against one of our therapists was dissolved and her other requests for restraining orders against our clients were denied.
