Rebecca A. Young (Of Counsel-Birmingham, AL) obtained a dismissal order from the U.S. District Court for the Middle District of Alabama disposing claims of slander and harassment alleged against the firm’s insurance investigator client. The plaintiffs suffered a fire loss on a rental property as a result of arson, to which the insurance investigator was assigned by the insurance company. The plaintiffs alleged that the investigator harassed and threatened them – especially damaging as he regularly serves as an expert witness. Rebecca moved to dismiss the claims of slander and harassment as unsupported under Alabama law and the court agreed and dismissed those claims. Following the favorable order, Rebecca was able to secure a voluntary dismissal of the remaining claims of outrage and wrongful intrusion by confronting the plaintiffs’ counsel with evidence demonstrating the claims were completely unfounded and grounds for Rule 11 sanctions if not dismissed.
