Sasha Grandison (Of Counsel-New York) and Eugene Boulé (Partner-New York) obtained summary judgment in a Bronx County Labor Law case dismissing all claims against the firm’s client, a general contractor. The plaintiff alleged violations of Labor Law sections 200, 240(1), and 241(6) that caused him to sustain severe injuries at a job site when sheetrock stacked against a wall at the premises fell on him. After discovery, Sasha and Gene moved for summary judgment and argued that our client was not a proper Labor Law defendant, as it was the general contractor for construction work performed to the common areas of the premises, not to the interior of the individual units. They relied on the plaintiff’s testimony that he worked on the interior of the units and his employer (the non-party property management company) had supervisory control over his work. In addition, the plaintiff’s accident occurred inside a unit that was not even listed on the work permit. The court granted our motion and dismissed all of the claims asserted against our client.
