Doug Kemper (Of Counsel-Louisville, KY) obtained a jury verdict awarding plaintiff only 7 percent of the damages she sought for a motor vehicle accident in Letcher County, KY,  Circuit Court. In the low impact-collision, the firm’s client rear-ended the car in which the plaintiff was a passenger. No injury was reported at the scene, but plaintiff went to the emergency room, was given an anti-inflammatory drug and released. Doug noted there was evidence of attorney-directed subsequent treatment and that the plaintiff had significant preexisting degenerative spinal issues at all levels of her spine, but claimed the accident increased pain levels, causing her to need fusion surgeries in both the lumbar and cervical spine. During the trial, the court granted directed verdict on punitive damages and future impairment claims. At the conclusion of trial, the plaintiff asked the jury for $73,000 in past medical bills, $160,000 in future medical bills and $5 million in pain and suffering. The jury awarded $70,000 for past medical bills, $300,000 for past pain and suffering and nothing for future meds or pain and suffering.
