Kara Thorvaldsen (Partner-Boston, MA) succeeded in her motion for summary judgment on behalf of a national real estate investment company in Suffolk Superior Court, Massachusetts. The plaintiff claimed to have sustained serious and permanent injuries, including a traumatic brain injury, following a criminal assault and battery in the lobby of a luxury apartment building. The plaintiff sued the alleged attackers, the building owner, the management company and the independent contractor that provided 24-hour concierge services for the building. The plaintiff alleged the attack was foreseeable based on a history of disorderly and intoxicated patrons of an adjacent nightclub entering the lobby of the apartment building. Kara was able to develop a summary judgment record showing that there was no evidence of any prior similar incidents; as a result, the court held that as a matter of law, there was no duty on the client's part to prevent violent criminal attacks.
