Eleanor G. Jolley has more than eight years of experience practicing in a range of general litigation and employment matters. She focuses on aviation, employment, premises and transportation matters. Eleanor advises clients in all stages of litigation, and has secured victories at the trial and appellate levels.
Prior to joining Wilson Elser, Eleanor represented national retailers, restaurants and financial institutions in state and federal courts. While in law school, Eleanor served as a Caruthers Fellow and as a judicial intern with the Honorable J. Scott Vowell, then Presiding Judge of the Tenth Judicial Circuit of Alabama.
Aviation
Eleanor is an active member of the firm’s aviation team, which represents legacy airlines, major defense contractors, helicopter operators and a variety of other aviation companies. These complex cases involve highly technical issues and allegations of severe damages and wrongful death.
Employment
Eleanor represents employers and staffing agencies in all aspects of employment litigation, including allegations of harassment, discrimination and retaliation. She has represented clients before federal, state and local agencies.

Eleanor is involved in a wide variety of general liability claims, including the defense of owners and operators of commercial properties, hotels, restaurant chains and other businesses.
Transportation
Eleanor represents major transportation, cargo and logistics companies in all types of liability matters, including personal injury and wrongful death claims and regulatory compliance issues. Eleanor is a member of the firm’s 24/7 response program, helping to ensure that team members are engaged during the first critical hours following a major incident.
Eleanor Jolley (Partner-Atlanta, GA) and Rebecca Young (Partner-Birmingham, AL) obtained dismissal of all claims made against a multinational energy corporation accused of negligently and wantonly allowing the plaintiff to be brutally assaulted at two of its fuel-branded gas stations. Eleanor and Rebecca argued that all of the claims were time-barred and that the plaintiff had failed to prosecute the claims by failing to properly serve the complaint on the appropriate legally recognized agent. The plaintiff argued that his service on an individual owner for one of the fuel stations was sufficient service. In response, Eleanor and Rebecca maintained that there was insufficient evidence to show the level of control necessary to establish agency and that an alleged parent-subsidiary relationship alone was insufficient to establish agency for purposes of effectuating service of process. Following briefing and oral argument, the Circuit Court of Tuscaloosa County, Alabama, granted our dispositive motion dismissing all the claims with prejudice.

Jeremy Stephenson (Of Counsel-Charlotte, NC), Joshua Cash (Partner-New York, NY) and Eleanor Jolley (Partner-Atlanta, GA) successfully defended the second-largest self-storage company in the country on appeal before the North Carolina Court of Appeals. The plaintiff, a customer of the client, sued under various commercial tort theories after her units were burglarized. After a winning defense in the jury trial, including a directed verdict on most counts and others prevailing before the jury, the plaintiff appealed and the appellate court issued an Opinion finding no error by the trial court, and securing a complete victory for the client.

Parks Stone (Partner-Atlanta, GA), Michael Manfredi (Partner-Atlanta, GA) and Eleanor Jolley (Of Counsel-Atlanta, GA) prevailed at the Georgia Court of Appeals in a libel and slander case filed against our client defense attorney for comments made to opposing counsel during the course of the underlying litigation. Our client made comments to opposing counsel regarding the nature and extent of the appellant doctor’s services and billing practices. The doctor filed the lawsuit seeking to silence our client by asserting claims for libel and slander. Parks, Michael and Eleanor sought dismissal under Georgia’s anti-SLAPP free speech statute on the grounds the communications were privileged, protected, and made in good faith and in furtherance of a legitimate interest. The trial court agreed in part, finding the communications were protected but not privileged. The Court of Appeals reversed and remanded the trial court’s decision on the grounds the comments were made in furtherance of his clients’ legitimate interests, were limited in scope and occasion, and published only to proper persons. As such, they were considered privileged and protected under Georgia law. The trial court was accordingly ordered to consider on remand our client’s request for attorneys’ fees and litigation costs incurred throughout the defense of the appellant’s claims.
