Diana Estrada (Partner-Los Angeles, CA) and Jennifer Brody (Associate-Los Angeles, CA) defeated a motion to certify a class of California nurses in a case where the plaintiff filed a wage-and-hour class action lawsuit alleging our client, a leading provider of travel health services globally, failed to provide legally compliant meal and rest periods and/or pay statutory premiums in lieu thereof, failed to provide accurate wage statements, and failed to pay all wages due upon termination. The plaintiff claimed that our client scheduled patient appointments without allocating time for putative class members to take statutorily required breaks. We opposed the motion to certify and demonstrated that the plaintiff had not sustained his burden of establishing that common issues will predominate. By attacking the credibility and admissibility of evidence presented by the plaintiff and introducing their own critical pieces of evidence, Diana and Jennifer were able to establish that the plaintiff simply had failed to show that there is a class-wide common policy or practice. Accordingly, the court denied the motion for class certification.
