Diana noted that she understood the appellate panel’s ruling in this case because both traveling and non-traveling employees were paid the per diem, but she said it was an “unfortunate decision … the whole purpose of per diems is to allow the employer to avoid the administrative hassle of collecting regular receipts and records associated with expenses.” She advises clients "to be very careful in ensuring that what they are paying out for expense reimbursement is closely tied to what each of their employees are incurring in expenses.”
