Eric Kaufer provides claims management, insurance coverage analysis and risk management services to insurers engaged in underwriting or reinsuring programs for various professional lines. He serves as claims and coverage counsel and provides opinions in coverage matters arising from business disputes and corporate insurance defense, with a concentration on lawyers, directors and officers, and other professionals’ errors and omissions, employment practices and cyber liability programs. Eric is the single point of contact for various programs and proactively keeps his clients up to date on all facets of each matter. With this in mind, Eric helps to oversee all claims on a program basis, using firmwide processes and technology to better provide services cost-effectively.

Communicating with professionalism and responsiveness, Eric delivers cost-effective management and resolution of claims along with counseling to effectively mitigate risk and reduce or eliminate exposures. He focuses on the important balance between indemnity and expense, prompt and professional communication with carriers and their insureds, and accurate reporting and reserve recommendations.

Eric specializes in early settlement of coverage and liability disputes on behalf of foreign- and domestic-based insurers. He defends and resolves matters on behalf of his clients, and his diverse skillset makes him a valuable asset at the initial notice of a claim or when he is brought in to manage ongoing complex and protracted matters.

Insurance Coverage, Professional Liability
Eric’s abilities range across various professional liability lines of coverage, with an emphasis on lawyers professional liability (LPL); directors and officers (D&O) liability; errors and omissions (E&O), specifically as to insurance agents & brokers and real estate professionals; miscellaneous professional liability (MPL); and employment practices liability (EPL). Eric handles a variety of insurance coverage and reinsurance matters, and often is engaged to evaluate, negotiate and resolve coverage issues on behalf of insurers.

Directors & Officers
Eric regularly represents D&O insurers as coverage and monitoring counsel in all types of matters, from high-profile regulatory investigations to complex commercial litigation. He knows how to navigate the numerous complex issues surrounding D&O claims, including shareholder derivative actions, class action securities litigation, D&O policy coverage disputes, data breach and other cyber liability claims, and more.

Employment Liability
Eric’s practice includes coverage assessments and representations in advocating for favorable resolutions of EEOC charges and civil actions. These actions involve a wide range of claims for violations of state and federal employment laws, including discrimination allegations, wrongful termination, sexual harassment and retaliation claims.
