Eric Phillips has more than 28 years of experience representing insurance- and construction-industry clients in connection with a broad range of complex, high-risk disputes totaling nearly $1 billion at issue in mediation, arbitration and litigation. Eric has represented these clients in some of the nation's largest disputes involving bridges, highways, hospitals, airports, joint intermodal terminals, power plants, high schools, ski resorts and hotels, among others. He also represents insurance- and construction-industry clients in connection with disputes involving commercial and residential projects in the San Francisco Bay area. In addition, Eric has successfully served as a mediator in more than 500 contested matters, ranging from disputes involving real property, construction and breaches of contract to negligence and torts, among others.

Construction / Construction Defect
Eric represented a client in litigation against a design-build contractor and takeover surety in connection with the design and construction of a 12.75 megawatt combined-cycle, cogeneration power plant. The matter alleged construction delay and defect claims in excess of $30 million. After nine years of litigation, which included successfully defending a series of interlocutory appeals through the California Supreme Court and the Supreme Court of the United States, the matter settled in the client's favor.
