But what happens when a breakdown or failure requires repair or replacement and also causes damage to the host structure or shuts down the project while repairs are being made? Who pays what? The answers lie in the CGL’s so-called “business risk exclusions” ‒ Exclusions J through N. In this session, we will trace the history of these exclusions and where courts have drawn the line between covered and uncovered amounts.
