Claims professionals will gain a clear understanding of the reservation of rights letter (ROR) and what it is intended to do; what must be in an ROR to avoid waivers and other adverse consequences; what can be in an ROR for greater protection, depending on the circumstances; when an ROR must be sent to be timely under applicable laws and regulations; what impact an ROR can have on the insurer’s ability to control claims handling; and what practical aspects should be taken into consideration when sending an ROR. This discussion includes the differences between RORs and denial letters, and when there may be a need to issue supplemental or multiple RORs. RORs are often vital to dealing with and defending against coverage disputes and bad faith allegations.
