Los Angeles, California, partner Gregory Lee and of counsel Carl Basile successfully defended one of the county's largest mall operators and a global security services company against a racial discrimination lawsuit brought by a mall guest who had been arrested at the mall and erroneously accused by law enforcement of being involved in an organized theft ring before eventually being released. The plaintiff alleged that employees of the firm's clients had wrongfully identified her a criminal suspect based upon her race and skin color, and sued for violations of the Unruh Civil Rights Act, among other claims. During the discovery process, Greg and Carl marshalled undisputed evidence demonstrating that law enforcement had acted on their own, and that none of the employees of the firm's clients were involved in the identification, detention or arrest of the plaintiff. The Los Angeles court agreed and granted their motion for summary judgment.
