Hunter, Delay and Kersting Prevail in ERISA-Governed Rescission Action

Ramona Hunter (Partner-Seattle), Hailey Delay (Associate-Seattle) and Edna Kersting (Partner-Chicago) obtained a default judgment and a fee and cost award in favor of their life insurance client in an ERISA-governed rescission action. After the client had rescinded life insurance coverage under an ERISA-governed plan and subsequently filed a lawsuit in the U.S. District Court for the Western District of Washington, the beneficiary failed to appear and respond, resulting in an entry of default against her. The court subsequently granted Ramona, Hailey and Edna’s motion for default judgment and awarded the client its fees and costs incurred in pursuing the litigation.
