Noelle K. Sheehan (Partner-Orlando, FL) and Tai Phetsanghane (Of Counsel-Orlando, FL) obtained summary judgment for a national mall maintenance company and a shopping mall owner in a negligence/ premises liability lawsuit in the Circuit Court, Seminole County, Florida. The plaintiff alleged that he slipped and fell on a foreign substance near the mall’s escalator, resulting in multiple injuries and surgeries with significant medical bills. Noelle and Tai argued that the plaintiff could not prove actual or constructive notice of the foreign substance, as required under Florida law. The court agreed and entered summary judgment as a matter of law in favor of the firm’s clients, putting an end to five years of litigation.
