Dallas, Texas, of counsel John Goodwin and Aaron Stendell were interviewed regarding an article titled “General Liability Insurance Cases to Watch in 2022,”which appeared in the January 3, 2022, edition of Law360. John and Aaron discussed a case on the “eight-corners” rule and the debate on whether courts are permitted to see evidence outside of the policy language and allegations in the underlying complaint. John noted, “What we really need is a definitive rule one way or the other. … Allowing Texas federal courts and state appellate courts to apply different rules is not desirable." Aaron said that Texas high courts will be reluctant to change the 60-year-old rule based on questions posed by justices in oral argument.
