Edward M. O’Brien (Of Counsel-Louisville, KY) obtained summary judgment in favor of an automobile insurance client in a Kentucky state court. After settling with the at-fault party’s liability carrier regarding an accident in which the plaintiff was injured, she sought to recover underinsured motorist (UIM) benefits from the firm’s client, which issued an insurance policy to an individual with whom the plaintiff was romantically involved. Eddie argued that the plaintiff was not an insured person under the policy by virtue of that relationship and, therefore, her claim was not covered. The plaintiff argued that the policy language violated Kentucky law and public policy. The trial court agreed with Eddie and granted summary judgment in favor of the firm’s client.
