Sheri Thome (Partner-Las Vegas, NV) obtained summary judgment in the United States District Court, District of Nevada on behalf of an insurance carrier who argued that an aviation policy did not cover an accident involving a non-scheduled pilot. The pilot who was flying on the date of the accident had not submitted a pilot application with the insurer, thus was not reviewed or approved as a scheduled pilot.  Claimants filed suit as a result of the accident and the Sheri filed a declaratory relief action seeking a declaration of no coverage and no duty to defend on behalf the carrier. The court granted the summary judgment motion and entered judgment in the carrier’s favor.
