A team of Wilson Elser Art Law practitioners – Jana Slavina Farmer (Partner-New York Metro), Adam Buchwalter (Partner-Madison, NJ), and Dara S. Elpren (Associate-New York, NY) – authored the April 9, 2025, update of “Art & Cultural Property Law 2025,” a practice guide published by Chambers and Partners USA. The guide analyses key questions of U.S. law pertaining to art and its market, drawn from multiple fields, including intellectual property, contracts, taxation, and cultural property law, among others. Art Law in the United States is shaped by a patchwork of federal and state statutes and court decisions augmented by customized agreements created by art market participants to address gaps in existing legal frameworks. The practice guide is prepared for general audiences, and discusses key topics that those interested in familiarizing themselves with U.S. Art Law would want to know, including the categories of rights to an artwork, artist-dealer relationships, rules pertaining to sale of art at auction, issues of provenance and authenticity, cultural heritage protections, gifts and donations of art, art placed in trust, inheritance considerations.
