Bortnick (Of Counsel-San Diego, CA) collaborated on an article in Thomson Reuter’s Westlaw Today on June 26, 2022, “Five states have new privacy laws coming in 2023 so get ready … although the latest federal bill may change everything.” The authors present a roundup of new and upcoming legislation and their application for businesses: “If a business engages in certain processing activities considered to be high risk – such as targeted advertising, sale of personal data, processing of sensitive personal data and any other processing activities that present heightened risk of harm to consumers – data protection assessments must be conducted to meet the privacy laws' principles of data minimization, purpose, proportionality and so forth, and to reduce the risk of violations as the laws evolve, lest a ‘parable of horribles’ follows.”
