Jason Waters (Partner-Virginia) prevailed in a motion to dismiss for a client manufacturer of navigation and auto-pilot systems in the U.S. District Court for the District of Maryland. Plaintiffs were the estates of two fishermen who died in an accident off the Maryland shore when their fishing boat capsized. They sued the captain and owner of the vessel, who commenced a third-party action for contribution and indemnification against our client. The owner and captain claimed that the navigation and auto pilot systems contributed to the loss of the vessel by maintaining the preset course in challenging weather and current conditions. Jason moved to dismiss for lack of personal jurisdiction and failure to state a claim, and the court granted our motion to dismiss on jurisdictional grounds.
