Julia Young (Of Counsel-Orlando, FL) obtained summary judgment in the United States District Court for the Southern District of Florida on behalf of an insurance company client. The plaintiff sought approximately $300,000 to cover alleged damages to a commercial establishment in West Palm Beach, Florida, resulting from a "raw sewage backup." Julia, interpreting new policy language upon which courts had not previously ruled, argued, based, in part, on analogous case law, that coverage for the plaintiff's loss was expressly and unambiguously excluded by the subject policy as a matter of law. The motion for full and final summary judgment was granted in favor of the carrier.
