Peter Lauricella (Partner-Albany, NY) and Kadeem Wolliaston (Associate-Albany, NY) collaborated on “Dallas Federal Court Temporarily Blocks FTC Noncompete Enforcement,” which appeared in CLM Magazine on July 16, 2024. The authors discuss a decision by Judge Ada Brown of the U.S. District Court for the Northern District of Texas that granted a request by the U.S. Chamber of Commerce and a Texas-based tax firm for a preliminary injunction seeking to prevent the Federal Trade Commission’s rule banning “noncompete” clauses in employment agreements. Peter and Kadeem conclude, “Despite this ruling, we anticipate there will be further developments before the FTC rule is set to go into effect … employers should be proactive in reviewing and updating their employment agreements to carefully craft noncompetes so as to prevent the certain legal challenges to come.”
