Lawrence Lee Washburn (Partner-Atlanta, GA) and Darshan Patel (Associate-Atlanta, GA) prevailed on a motion for summary judgment in Henry County State Court, Georgia, on behalf of a charitable food distribution center client in a premises liability matter. The plaintiff fell on a water drain while loading her truck on the distribution center’s property. She filed a complaint alleging the center had superior knowledge of the defect and failed to warn her of the hazard. Lee and Darshan argued the water drain was a static condition and that the plaintiff had an unobstructed view of the drain, therefore the firm’s client had no responsibility to warn the plaintiff of its existence. The court agreed and noted there was no evidence that the drain was negligently designed or maintained, granting summary judgment.
