Max Billek (Partner-New Jersey) and Mike Chipko (Partner-New Jersey) obtained a judgment in favor of an attorney following a two-day hearing before a New Jersey Office of Attorney Ethics panel. The client was charged with violation of RPC 8.4(c), professional misconduct for a lawyer to “engage in conduct involving dishonesty, fraud, deceit or misrepresentation.” Due to the serious nature of the charge, the client was not eligible for admission to a diversionary program and thus had to accept either a public sanction or proceed to hearing. The hearing resulted in a unanimous finding in favor of Max and Mike’s argument that the charge had not been proven by clear and convincing evidence and the attorney was fully exonerated.
