Joshua Bachrach (Partner- Philadelphia, PA) was quoted in a June 25, 2021, Bloomberg Law article titled “Slow to Start, Covid [sic] Disability Insurance Litigation Is Coming.” The piece discusses looming litigation regarding disability payments from insurance companies to people who can no longer work after contracting the COVID-19 virus. Momentum in these types of cases has been stalled due to a variety of pandemic-related factors, but was already a slow-moving process due to the Employee Retirement Income Security Act (ERISA). According to Josh, the Labor Department’s deadline extension on disability payments could mean that it will be another year or two before much of the litigation on this matter is seen by the courts. “Not every attorney, not every claimant is taking advantage or needing to take advantage of the extension,” he said.
