C​ynthia Maskol (Partner-Washington, D.C.) prevailed in an ERISA lawsuit brought by an attorney who claimed she was wrongly denied long-term disability benefits for her fibromyalgia, chronic fatigue and abdominal and joint pain. In a 52-page opinion, the U.S. Magistrate Judge stated,  "In this case, the administrative record contains ample evidence that [the insurer’s] reviewing physicians performed multiple rounds of review of plaintiff's claims file, which is a strong indication that [it] was not biased but, rather, tried to administer the plan fairly." The judge added that it was reasonable for the insurer to find that the plaintiff’s subjective reports of pain were credible, but ultimately gave them less weight because she did not appear in acute distress at her medical appointments and was therefore capable of working at the firm.
