Lori Semlies (Partner-White Plains, NY | New York, NY) was quoted in the May 9, 2022, edition of Skilled Nursing News in an article titled “Covid-Related Nursing Home Lawsuits to ‘Skyrocket’ with Protections on Shaky Ground.” The beginning of the COVID-19 pandemic resulted in a staggering death toll across health care facilities. With the wrongful death statute of limitations set to expire this year in places such as New York, Lori says litigation is on the uptick. While state-by-state immunity laws and federal legislation provide partial protections for COVID-19-relaterd lawsuits, Lori notes that staffing ratios could come into play in a plaintiff attorney’s arguments. “I think this regulation will invite more [litigation] because it’s black and white, about the number of nursing hours. You’ll hear from the nursing home industry … that regulation is creating an impossible scenario for them when there is a staffing crisis in the country,” says Lori.
