Miami Team Secures Dismissal for Out-of-State Defendant in High-Exposure Commercial Litigation

Matias Valenzuela (Associate-Miami) and Russell Pfeifer (Partner-Miami) secured dismissal in Miami-Dade County Circuit Court on behalf of Wilson Elser’s client, an out-of-state defendant in a high-exposure commercial litigation matter, successfully challenging the court's authority to hear the case. The plaintiff sought to pursue significant claims in Florida despite our client's lack of meaningful ties to the state. Matias argued the motion, demonstrating that the plaintiff failed to establish the kind of connection between the client and Florida required before a Florida court could exercise authority over an out-of-state party. Following oral argument and the submission of competing proposed orders, the court adopted Wilson Elser’s position and dismissed the claims against our client. The win spared the client the substantial expense and exposure to protracted litigation in a forum with no meaningful connection to him and underscores the Miami team's ability to identify and successfully press dispositive threshold defenses before a case ever reaches the merits.
