Richard Brahan (Associate-McLean, VA) succeeded in a motion to dismiss, with prejudice, on behalf of an orthopedic surgeon in a medical malpractice case in Fairfax Circuit Court. The plaintiff, pro se, alleged that our client committed malpractice during an Achilles’ tendon repair. However, the plaintiff failed to comply with the court’s rules and requirements, from failing to timely and properly serve the Complaint, to failing to obtain a proper expert certification stating that our client had violated the standard of care and caused the plaintiff’s injury. Various judges gave the plaintiff more time to comply, but ultimately he could not do so.
