Robert Goodson (Partner-Washington, DC) and James Lopez (Associate-Washington, DC) obtained a defense verdict for a plastic surgeon, in the Superior Court of the District of Columbia following two weeks of trial after a 50-minute jury deliberation. Plaintiff was a 73-year-old man with diabetes, hypertension, hyperlipidemia, coronary artery disease – with eight cardiac stents – obesity and sleep apnea. The case involved a complex 18-hour elective plastic surgery operation, including a 360° abdominoplasty, bilateral medial thigh lift, bilateral gynecomastia revision, and liposuction. Plaintiff experienced a number of post-operative complications requiring six days of recovery in the intensive care unit and was hospitalized for ten days following the procedure. Plaintiff also experienced postoperative wound break-down, infection, and dehiscence, which resolved over the course of eight months, and permanent scarring he attributed to negligence by his plastic surgeon.
