Robin Gregory (Partner-New York) and Ashley Humphries (Of Counsel-New York) secured a defense verdict in a medical malpractice case in Supreme Court, New York County on behalf of the firm’s hospital client. The plaintiff, who was morbidly obese, alleged that the operative team failed to secure his legs with a mid-calf strap for an eight-hour surgery and his left leg fell off the OR table causing left lower leg neuropathy, permanent loss of sensation, paresthesia, pain, weakness and difficulty ambulating. Robin and Ashley maintained that a mid-calf strap was contraindicated as it would have increased the risk of a DVT, pulmonary embolism and death, and that the surgical team properly reassessed the patient once the leg was found to have “veered” toward the edge without falling below the level of the table and appropriately determined that the risk of the leg falling off the table now outweighed the risk of DVT, thus warranting placement of the additional strap. They noted the plaintiff’s compression injury, a recognized risk of surgery, occurred due to the length of the surgery and the plaintiff’s comorbidities, despite appropriate treatment.
