John Shepperd (Partner-Houston) and Christina Huston (Of Counsel-Houston) convinced the plaintiff to drop her lawsuit against their physician client on the eve of trial before the 272nd Judicial District Court of Brazos County, Texas. The patient underwent an open reduction, internal fixation repair of an open fracture to her right leg. We represented the physical medicine physician who was in charge of the rehab care, and who instructed the rehab team to leave the surgical dressing untouched for fear of breaking the sterile field. After a week in rehab, the patient's wound began emitting a foul odor from an infection that took several months to eradicate. The patient's medical course remained difficult and her broken bones never healed, resulting in a below-the-knee amputation 18 months after the initial surgery. Plaintiff sued the doctor and the rehab hospital, and John and Christina’s client, who was the target defendant as he was directing all medical care, contended the dressing on wounds of this complexity should not be disturbed. Moreover, the initial injury was of such severity that an amputation was inevitable. The doctor also contended that the original infection had resolved, so any new infection had nothing to do with his medical decisions. The rehab hospital settled for a substantial sum a week before trial, and the plaintiff opted to not to proceed against the doctor and dismissed all claims against him with prejudice.
