Mathew Ross (Partner-White Plains) was quoted in Best’s Insurance News & Analysis in a March 25, 2020, article titled “Despite Questions of Coverage, Insurers Could Still Be Hit with Litigation Costs.” Ross acknowledged that consistency can be challenging in areas such as business interruption because of rapidly evolving civil authority directives and individual circumstances. “I believe almost every business interruption policy requires a physical damage loss. The $64,000 question is Do you have that?” For example, a restaurant closed with no evidence of contamination – likely because of an increasing number of state-ordered bans on sit-down dining – presents a different claim than one where an employee was diagnosed with COVID-19.
