Stephen P. Brown (Partner-Stamford) and Colleen Vellturo (Associate-Stamford) obtained dismissal in a Dram Shop Liability case before the Connecticut Superior Court in the Judicial District of Stamford/ Norwalk. The plaintiff claimed that a patron who physically assaulted him at a bar/restaurant was over-served alcohol by the bartender, and was visibly intoxicated prior to a verbal encounter that escalated to a physical assault.

We argued that the court was without jurisdiction due to the plaintiff’s failure to timely bring the action within the one-year statute of limitations imposed by C.G.S. §30-102, Connecticut’s Dram Shop Act. The court agreed with our analysis and argument, and granted the motion to dismiss from the bench.
