Douglas Connors (Partner-Stamford, CT) and Brian Del Gatto (Partner-Phoenix, AZ) obtained summary judgment in the Chautauqua Supreme Court of New York State in favor of a Canadian tractor trailer company and its driver in which the plaintiff sought damages for alleged injuries sustained in a multi-car pile-up on a snow-covered highway. The plaintiff alleged serious personal injury and demanded more than $750,000  to settle claims that all the defendants operated their respective vehicles in a negligent and/or reckless manner in light of the weather and road conditions. Doug and Brian argued that their clients had received CB warnings of the conditions, which allowed them to activate their emergency lights and safely stop without colliding with other vehicles prior to being struck in the rear by plaintiff and codefendants. Their arguments were supported by testimony of the plaintiffs and codefendants as well as dash cam video. The court agreed, finding no evidence to suggest that the our defendant was in any way negligent or reckless and the court granted summary judgment to the firm’s clients dismissing the plaintiffs’ claim as well as all cross-claims asserted by the codefendants. There is no doubt that without  the video the easy out for the court would have been the different description of the events and conditions existing at the time of accident creating a triable question of fact.
