Brett Corson (Partner-Boston) and Anne Kim (Associate-Boston) had their motion to dismiss granted in a Middlesex Massachusetts Superior Court case involving a licensed mental health counselor specializing in children experiencing family issues.  The client had become involved in a hostile custody and divorce proceeding as a neutral observer during supervised visitation.  Following an incident at the client’s center which was reported by the client, Plaintiff filed suit for defamation.  Plaintiff claimed statements made to the police, the DCF and in open court about the incident were defamatory and would negatively affect her career as a physician and her ability to obtain custody of her minor child.  Brett and Anne filed a motion to dismiss based on anti-SLAPP, the litigation privilege, and qualified immunity for mandatory reporters of child abuse. After 60-minutes of oral argument, the judge allowed Wilson Elser’s motion and dismissed the case citing the litigation privilege as an absolute bar to recovery, and reserving judgment on the other grounds. The plaintiff’s last demand before the resolution was $1,000,000.
