Brian Del Gatto (Partner- Phoenix, AZ) and Arman Nafisi (Of Counsel-Phoenix, AZ) obtained a dismissal before the Arizona State Board of Dental Examiners on behalf of an insured dentist. The claimant alleged she received “piecemeal” crown and bridge treatment from the insured. The insured advised the treatment was necessary because the claimant was traveling back and forth between Arizona and Florida throughout her treatment. After obtaining the claimant’s patient file and gathering the facts from the insured, Brian and Arman drafted a responsive brief. The Arizona State Board of Dental Examiners subsequently dismissed claimant’s complaint without a hearing. The dismissal is significant because, typically, the Board will allow a claimant an opportunity to have his or her case heard before an open session, but in this case the Board dismissed the complaint on the strength of Brian and Arman’s responsive brief.
