Michael Duffy (Partner-Chicago) and Edward M. O'Brien (Partner-Louisville) obtained affirmance of dismissal in a declaratory judgment action in the Indiana Court of Appeals on behalf of a home insurance company in liquidation. The plaintiff is a large state utility provider alleging it was the subject of bad-faith claims arising from environmental contamination actions and sued numerous insurers seeking a declaration of rights. Wilson Elser's client sought to dismiss the action arguing that the utility provider's claims must be pursued through the liquidation process. The plaintiff maintains that the insurer is a necessary party to the action and that the Indiana trial rule governing the joinder of necessary parties supersedes Indiana statutes governing the pursuit of claims against insurers in liquidation. The Court of Appeals unanimously affirmed the trial court's dismissal holding the decision had accorded full faith and credit to an out-of-state liquidation order as required by statute.
