Ashley R. Eagle (Of Counsel-West Palm Beach, FL) and Teresa C. Taglianetti (Associate-West Palm Beach, FL) obtained Summary Judgment in the 15th Judicial Circuit, Palm Beach County, Florida, on behalf of the Mall at Wellington Green. The plaintiff alleged that the tile floor in the mall was a dangerous condition because it becomes slippery when wet, but failed to adduce any record of evidence that a transitory foreign substance was on the floor at the time of her fall. Ashley and Teresa filed their Motion for Final Summary Judgment, arguing that the plaintiff failed to adduce any record evidence of a dangerous condition existing at the time of her fall and therefore could not meet the notice requirements under Florida Statute 768.0755. The court agreed and entered an Order finding that the plaintiff failed to meet her burden of proof. Accordingly, summary judgment was entered in favor of the mall.
