Chris Flanagan (Partner-Boston) and Chloe Angotta (Associate-Stamford) obtained summary judgment on behalf of the firm’s clients, who were alleged to be negligent with regard to a construction accident at their home. The homeowners hired a general contractor to renovate their home, and the general contractor engaged subcontractors to perform various work, including structural framing. The original general contractor was replaced with another general contractor during the course of the renovation and the new general contractor retained the plaintiff’s employer to spray foam insulation in the house. On the first day of spraying, the plaintiff positioned himself on top of a ceiling joist to perform his work, and while maneuvering into position, he fell 10 to 12 feet to the floor, sustaining a wrist fracture that required surgery. The plaintiff sued the firm’s clients, alleging that they had a non-delegable duty to keep the premises safe from defect. Chris and Chloe argued that the firm’s clients owed no duty to the plaintiff as they had ceded possession of the home and control over the construction project to independent contractors. The court agreed and granted summary judgment.
