Nicholas Freeman (Partner-Orlando) and Daniel McLeod (Associate-Orlando) defended a contractor before the Florida First District Court of Appeals, which issued a per curiam decision unanimously upholding summary judgment; the district court’s appellate order eliminated all claims against the client, securing a favorable result in a case with potentially significant exposure. The plaintiff was thrown off his bicycle and severely injured his hip after making contact with a raised portion of concrete installed by our client (essentially a speed bump in a parking lot). Nick and Daniel moved for summary judgment based on Florida’s Slavin doctrine, which stands for the proposition that a contractor cannot be held liable for injuries sustained by third parties when the injuries occur after the contractor completed its work, the owner of the property accepted the contractor's work and the alleged defects causing the injury were patent. The plaintiff took no more action and the deadlines to further appeal have passed.
