Kathryn Grace (Partner-McLean, VA | Washington, DC | Charlotte, NC) and Pete Greco (Associate-Orlando, FL) obtained a defense verdict in a two-day jury trial in Circuit Court for Montgomery County, Virginia, on behalf of an aviation repair facility. The pro se plaintiff brought his aircraft to the facility for significant repairs and alleged the repair facility breached an oral contract when the work was not performed in the time frame desired. The facility ceased work on the plaintiff’s aircraft due to threats of legal action. More than two years after the threats, the plaintiff demanded the “return” of the airplane. The client placed it outside for plaintiff to retrieve, but the airplane stayed there until plaintiff filed suit in 2018. The plaintiff sought damages for the breach of contract as well as for breach of bailment contract, focusing on the devaluation of the aircraft. Kathryn and Pete successfully obtained a directed verdict for the breach of contract claim and, after two hours of deliberations, the jury unanimously returned a defense verdict for the breach of bailment contract.
