Madonna A. Herman (Of Counsel-San Francisco, CA) obtained an arbitration award on behalf of a recruitment and staffing agency client, and successfully moved for the award of nearly $200,000 in attorney fees and costs and arbitration fees and expenses. A former contractor for the client had sued an information technology company for unpaid overtime wages and retaliation, and the technology company tendered the defense to the client pursuant to an indemnification clause. The agreement, however, provided that any claims that arose from negligence or intentional acts were not covered by indemnification. The technology company settled with the contractor and sued the firm’s client for its fees incurred in that action as well as those incurred through arbitration against the client. The arbitrator determined Madonna had proven the information technology company had breached its agreement and the client had performed its obligations.
