Michael Lowry (Partner-Las Vegas) has been recognized by the Las Vegas Defense Lawyers for helping to organize efforts that led to NRS 52.380 being deemed unconstitutional. The statute was sponsored by the local plaintiffs' bar and purported to regulate physical and mental examinations, replacing Nevada Rule of Civil Procedure 35. The statute upset the balance in tort litigation, violated separation of powers and negatively affected defendants' ability to defend themselves. After the statute was enacted, Lowry published an article in Nevada Lawyer  highlighting potential problems with the statute and arguments that it might be unconstitutional. Lowry then teamed with other defense lawyers to organize defendants harmed by NRS 52.380 so the statute could be challenged. Ultimately, many of the arguments in his article were incorporated into seven different writ petitions that led to Lyft v. Dist. Ct., 501 P.3d 994 (2021), declaring the statute was unconstitutional.
