Michael Lowry (Partner-Las Vegas, NV) submitted an amicus brief on behalf of the Las Vegas Defense Lawyers (LVDL) regarding a writ petition discussing how much detail the Nevada Rules of Civil Procedure (NRCP) 35 requires, both in a motion seeking an NRCP 35 exam and in the order granting that motion. The plaintiff argues for exacting specificity that includes every technique, test, procedure, and question that will be asked. However, NRCP 35 does not require the extensive degree of specificity that the plaintiff asserts, nor is it practical. LVDL’s brief notes that this is a recurring dispute that is frequently litigated and that appellate guidance would be helpful.
