Michael Lowry (Partner-Las Vegas, NV) submitted an amicus brief for Las Vegas Defense Lawyers concerning the pleading standard for punitive damages. A patient sued a hospital and requested punitive damages in the complaint. The hospital moved to dismiss the punitive damages allegations, but the district court denied the motion. The hospital filed a writ petition with the Supreme Court of Nevada asking it to review that order. LVDL submitted an amicus brief asking the Supreme Court to review the issue because it is one that frequently arises for its members. The pleading standard also is important to civil defendants because punitive damages are often uninsured and sometimes non-dischargeable in bankruptcy.
